Terms and Conditions
1. Introduction
Welcome to RealtorLawProUp! These Terms and Conditions govern the use of our services, programs, and offerings in the field of real estate legal services and professional representation. By engaging our legal services or entering into an attorney-client relationship, you agree to these terms and commit to fully complying with them.
2. Service Eligibility
2.1. Client Status – Our legal services are designed for licensed real estate professionals, realtors, and real estate agencies seeking specialized legal representation and compliance support. When engaging our services, we request information about your professional credentials, practice area, and specific legal needs to ensure appropriate service provision.
2.2. Representation – Participation in our legal representation services requires prior consultation and formal engagement agreement by RealtorLawProUp. You are obligated to provide accurate and current information regarding your legal matters.
2.3. Professional Guidelines – We expect professional conduct and compliance with all legal and regulatory requirements. Any form of misrepresentation, fraudulent activity, or unethical behavior may result in termination of legal representation.
2.4. Confidentiality – Clients commit to maintaining attorney-client privilege and confidentiality regarding sensitive legal matters and information shared during the course of our professional relationship and legal representation.
3. Service Engagement and Payment
3.1. Service Engagement – Legal service agreements can be made via our website, by phone, or in person and are binding after our written confirmation and signed retainer agreement.
3.2. Payment Terms – Legal service fees are due within 14 days of invoicing. We accept bank transfers, major credit cards, and certified cheques.
3.3. Corporate Engagements – For legal services engaged by real estate agencies for their agents, separate payment terms may be agreed, which are specified in the respective legal service agreement.
3.4. Cancellation Policy – For cancellations up to 14 days before scheduled legal services, 25% of the retainer will be retained; for cancellations up to 7 days before, 50%. For later cancellations, the full retainer will be charged subject to work completed.
4. Service Design and Changes
4.1. Legal Service Planning and Implementation –
- RealtorLawProUp reserves the right to modify service offerings, schedules, and assigned legal counsel.
- In case of scheduling conflicts or legal priorities, services may be rescheduled or reassigned.
- Service changes will be communicated to clients as early as possible.
4.2. Legal Documents – All legal documents, templates, and professional resources are the intellectual property of RealtorLawProUp or our legal partners. The materials may not be reproduced, distributed, or used for commercial purposes without written permission.
5. Specialized Services
5.1. Registration – For our Elite Partnership and specialized real estate legal services, separate engagement conditions apply, which are communicated before service commencement and are binding.
5.2. Cancellation Conditions – Cancellations for these comprehensive legal service packages must be made at least 21 days in advance to receive a partial refund. For later cancellations, 75% of the retainer will be retained.
5.3. Client Selection – For certain specialized legal services, we reserve the right to select clients based on criteria such as case complexity, professional qualifications, and practice capacity to ensure optimal legal representation outcomes.
6. Disclaimer and Warranty
6.1. Liability – RealtorLawProUp is only liable in cases of professional negligence or malpractice on the part of our legal team. We assume no liability for the business decisions made by clients based on our legal advice.
6.2. Professional Responsibility – Clients are responsible for the implementation of legal advice and compliance with regulatory requirements in their real estate practice. The application of legal counsel is at their own discretion and takes into account their specific business circumstances and risk tolerance.
7. Facilities and Property
7.1. Use of Facilities – Office facilities and equipment must be treated with care and respect. Clients are liable for any willful damage to our legal offices or equipment.
7.2. Valuables – We assume no liability for personal items and valuables left in our legal facilities. Secure storage options are available for sensitive documents.
8. Data Privacy
8.1. Data Processing – The processing of personal and professional data is in accordance with our separate Privacy Policy and attorney-client privilege requirements, which are considered essential parts of these Terms and Conditions and should be read carefully.
8.2. Photo and Video Material – At selected legal events and professional seminars, photo and video material may be created for documentation and marketing purposes. Clients can object to the use of their image at any time.
9. Refund Policy
9.1. Service Satisfaction – RealtorLawProUp is committed to providing exceptional legal representation and professional services. If you are not satisfied with our legal services or representation quality, please contact us within 7 days of service completion to discuss your concerns. We will work with you to address any issues and may offer appropriate compensation, such as partial refunds or additional legal consultation at no cost.
9.2. Service Cancellation by RealtorLawProUp – In the event that we must cancel or withdraw from legal representation due to conflicts of interest or professional obligations, we will provide a full refund of unused retainer fees or assist in transitioning representation to qualified legal counsel. We will make every effort to notify you of any representation changes as early as possible. 9.3. Refund Processing – All approved refunds will be processed within 14 business days and returned to the original payment method. Refunds are subject to our cancellation policy terms outlined in section 3.4 and may be prorated based on legal services already provided and work completed.
10. Final Provisions
10.1. Severability Clause – Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected.
10.2. Applicable Law – These Terms and Conditions are subject to Canadian law and the Law Society regulations of the respective provinces. The place of jurisdiction for all disputes is the location of RealtorLawProUp's headquarters, to the extent legally permissible.
